Foreclosure doesn't happen overnight. The timelines below show where you are in the process and where selling is still an option. Selling your home is often possible even after proceedings have started — the earlier you act, the more choices stay on the table.

Washington, DC

Non-judicial (primarily)

  1. Missed payment

    Day 1

    First mortgage payment is missed.

  2. Late payment notice

    15–30 days

    Lender sends a late-payment notice and late fees begin.

  3. Demand letter

    60–90 days

    A formal demand letter arrives — the account is now seriously delinquent.

  4. Notice of Default

    90–120 days

    The official Notice of Default is filed and the foreclosure process begins.

  5. Notice of Sale

    30 days before sale

    Public notice of the foreclosure sale is published.

  6. Foreclosure sale

    120–180 days total

    The property is sold at public auction.

Best window to sell

Best to sell before the Notice of Sale is published — roughly before day 150.

Maryland

Judicial foreclosure

  1. Missed payment

    Day 1

    First mortgage payment is missed.

  2. Pre-foreclosure notice

    45 days

    The lender is required to send a loss-mitigation notice.

  3. Intent to Foreclose

    90 days

    Notice of Intent to Foreclose is filed with the court.

  4. Court filing

    120 days

    Foreclosure lawsuit is filed in circuit court.

  5. Order to Docket

    150–180 days

    The court schedules the sale date.

  6. Foreclosure sale

    180–270 days total

    The property is sold at courthouse auction.

Best window to sell

Best window is before the court filing (before day 120) or before the Order to Docket (before day 180).

Virginia

Non-judicial (deed of trust)

  1. Missed payment

    Day 1

    First mortgage payment is missed.

  2. Default notice

    60 days

    Notice of default is sent to the borrower.

  3. Acceleration notice

    90 days

    Lender accelerates the loan — full balance now due.

  4. Notice of Sale

    14 days before sale

    Public advertisement of the foreclosure sale.

  5. Foreclosure sale

    120–150 days total

    The property is sold at trustee sale.
